What is Service of Process?
A service of process, or simply “process service,” is a legal procedure declaring that all parties must be notified when facing legal action against them in a court of law. It requires the in-person (face-to-face) delivery of a particular set of documents which describe the pending legal action to the individual at whom the legal action is directed. Following this procedure is part of compliance with the principle of Due Process of Law, which states that everyone’s legal rights must respected in judicial proceedings.
Examples that comprise court-ordered service of process documents include summonses, complaints, subpoenas, and writs, among others. Serving court-ordered documents must be performed by someone who is not a party to the case, called a “process server.”
Why use a third party to serve legal documents?
An unbiased third-party Process Server ensures successful delivery of the formal notification of the legal action to the recipient(s). This requirement also ensures that service of process complies with local laws.
