FMLA is not absolute right to reinstatement
The 7th U.S. Circuit Court of Appeals held that the right to reinstatement is not absolute, recently upheld the termination for poor performance of an employee who was out on covered leave. In other words, employers may fire an employee on FMLA leave for poor performance if the employee would have been fired regardless of the leave.
